TERMS & CONDITIONS OF VEHICLE AUCTION SALES
1. The highest bidder to be the purchaser but if any dispute arises s to the last or best bidder, the lot in dispute shall be put up again and resold, provided the Auctioneer cannot decide who was the last or best bidder.
2. No person will be allowed to retract his or her bid after being taken and the Vendor reserves the right to bid either by the Auctioneer or the Vendor’s agent for any lot offered.
3. The Auctioneer may refuse to accept any bid or withdraw any lot from the sale.
4. The Auctioneer may hold a bid and refer such bid to a Vendor before acceptance.
5. All purchases shall of the fall of the hammer, if required to do so, pay to the Auctioneers a deposit of $500.00 in cash or bank cheque and pay the balance in cash or bank cheque within 48 hours of the time of purchase.
6. In case of non-payment of such deposit, the lot or lots may at the option of the Auctioneer be put up again and resold and the defaulter’s bid at the option of the Auctioneer shall not be taken again during the sale.
7. All lots displayed with NO STATUTORY WARRANTY having been made available for inspection; must be taken as they are and neither the Vendors nor the Auctioneers will be liable for any misdescription of the goods. The said lots are to be taken with all faults (if any) and no guarantees of any nature whatsoever as to the goods sold are given by the Vendors of Auctioneers.
8. Any deficiency in the goods sold not vitiate the sale, but neither the Vendors nor the Auctioneers shall be bound to deliver more than is in their possession.
9. All lots shall be at the buyers risk on the fall of the hammer and neither the Vendors nor the Auctioneers shall be accountable for any deficiency, damage or loss which may arise thereafter.
10. Stamp duty and delivery charges to be paid by the purchases where and when applicable.
11. All goods must be taken away by the purchasers no later than 48 hours following the sale. No parties will be allowed to remove their lots, or any portion thereof, until the purchase shall have been completed and the full purchase price paid to the Vendor or the Auctioneer.
12. Storage charges may apply on lots which have been paid for and which remain uncollected 48 hours following the sale.
13. The Auctioneers shall not be responsible for any damage to property or injury to persons incurred during the removal of lots purchased.
14. All vehicles are sold as unregistered unless otherwise stated by the Auctioneer.
15. Engineers Reports are prepared as a result of a brief road test undertaken prior to auction, and are intended as a guide only. No detailed inspection has been undertaken, and so absolutely no warranty or guarantee concerning known or unknown faults is given or implied. The report covers no items capable of visual inspection. Vehicles with Engineers Reports are still sold subject to clause 7 of the Standard Terms and Conditions of Sale, which refers to vehicles being sold with all faults (if any).
16. Upon any purchaser failing to comply with any of the above conditions any money deposited in part payment shall be absolutely forfeited and all lots uncleared may be resold by Public Auction or Private Contract and the deficiency (if any) on such resale, together with all cost and charges consequent upon such resale shall be made good by the defaulter at this sale.
17. Terms are strictly CASH or BANK CHEQUE before delivery.
Guarantee of title
All vehicles are guaranteed with clear title i.e. not stolen or any money owing, via the Personal Property Securities Register (PPSR) Search – A certificate is supplied and a $25 Fee applies.
Buyers Premium
A Buyer’s Premium is charged on top of the price of the vehicle and amounts to 5% of the purchase price, with a minimum of $100 and a maximum of $500.

Registration
When a current safety certificate is issued for a vehicle it will be noted by the auctioneer and displayed in the passenger side window of the vehicle. If registered, you will be required to sign a transfer of Registration form and pay stamp duty for the car (% of purchase price) and a transfer fee. The car will then be automatically transferred into your name. Vehicles sold unregistered with a safety certificate can be fully registered on your behalf (fees apply). Where the vehicle has no Safety Certificate, the vehicle is sold unregistered. Before it can be registered the purchaser will need to obtain a safety certificate from a qualified mechanic.
Moving unregistered vehicles
You can apply for an unregistered vehicle permit to drive an unregistered vehicle on the road at Queensland Transport. The vehicle must be in a safe condition and must comply with the applicable safety and design standards – if it is not in a safe condition or does not comply with the standards, it must be transported or towed by a tow truck.

Payment
A minimum deposit of $500 is to be left on the day and full payment is to be made by 4pm Tuesday. Cash, Bank Cheque & EFTPOS are accepted and direct deposit is available for final payment. Keep in mind some EFTPOS cards do have daily limits and surcharges apply for Credit Cards. No personal cheques accepted.
Cooling Off
Examine vehicles closely as the Cooling off Period does not apply to vehicles sold by auction houses.
Inspect Carefully
You must be prepared to make your own assessment. Our engineers’ reports are displayed on the dashboard of all cars but it should be noted that no guarantee can be given that there are no other faults or defects with the vehicles.
